3 | Bahrein legde bij de bekrachtiging de twee navolgende verklaringen af:

De Regering van Israël heeft op 14-05-1990 tegen de door Bahrein bij de bekrachtiging onder ii afgelegde verklaring het volgende bezwaar gemaakt: The Governement of the State of Israel has noted that the instrument of ratification by Bahrain of the above-mentioned Convention contains a declaration in respect of Israel. In the view of the Government of the State of Israel such declaration, which is explicitly of a political character, is incompatible with the purposes and objectives of this Convention and cannot in any way affect whatever obligations are binding upon Bahrain under general international Law or under particular Conventions. 4 | De Verenigde Staten legden bij de bekrachtiging de twee navolgende verklaringen af:

De Regering van Mexico heeft op 10-07-1990 naar aanleiding van een van de door de Verenigde Staten van Amerika bij de bekrachtiging afgelegde verklaringen het volgende bezwaar gemaakt: The Government of the United Mexican States considers that the third declaration submitted by the Government of the United States of America, which, in its English version, reads: ‘(3) Pursuant to the rights of the United States under Article 7 of this treaty to deny requests which prejudice its essential interests, the United States shall deny a request for assistance when the designated authority, after consultation with all appropriate intelligence, anti-narcotic, and foreign policy agencies, has specific information that a senior government official who will have access to information to be provided under this treaty is engaged in or facilitates the production or distribution of illegal drugs.’, constitutes a unilateral claim to justification, not envisaged in the Convention, for denying legal assistance to a State that requests it, which runs counter to the purposes of the Convention. Consequently, the Government of the United Mexican States considers that such a declaration constitutes a reservation to which it objects. 5 | De DDR legde bij de bekrachtiging de volgende verklaring af: Requests for mutual legal assistance under Article 7 shall be directed to the German Democratic Republic through diplomatic channel in one of the official United Nations languages or in the German language unless existing agreements on mutual legal assistance inclued other provisions or direct communication between legal authorities has been determined or developed on a mutual basis. 6 | Bekrachtiging door Cyprus onder de volgende verklaring: As a result of the occupation of 37% of the territory of the Republic of Cyprus, which since 1974 is occupied by Turkish troops in violation of the United Nations Charter and of basic principles of international law, the Government of the Republic of Cyprus is prevented from exercising its legitimate control and jurisdiction throughout the territory of the Republic of Cyprus and consequently over those activities in the illegally occupied area which are related to illicit drug trafficking. . | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
7 | Bekrachtiging door Bolivia onder de volgende voorbehouden: Upon approving and ratifying the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances and in accordance with the principles of international law which recognize the sovereign right of States to formulate reservations, observations or clarifications to the texts of international treaties and conventions, the Republic of Bolivia expressed its reservation in accordance with Act No. 1008 of its internal legislation concerning the régime governing coca and controlled substances, and declared the inapplicability to Bolivia of those provisions of the Convention which could be interpreted as establishing as a criminal offence the use, consumption, possession and cultivation of the coca leaf for personal consumption. For Bolivia those provisions are contrary to principles of its Constitution and basic concepts of its legal system which embody respect for the culture, legitimate practices, values and attributes of the nationalities making up Bolivia's population. For much of Bolivia's population the licit use of the coca leaf is a tradition that dates back over centuries. In reiterating this reservation the Republic of Bolivia considers that: The coca leaf is not, in and of itself, a narcotic drug or psychotropic substance, The use and consumption of the coca leaf do not cause psychological or physical changes greater than those resulting from the consumption of other plants and products which are in free and universal use, The coca leaf is widely used for medicinal purposes in the practice of traditional medicine, the validity of which is upheld by WHO and confirmed by scientific findings, The coca leaf can be used for industrial purposes, The coca leaf is widely used and consumed in Bolivia, with the result that, if such an interpretation of the above-mentioned provisions was accepted, a large part of Bolivia's population would have to be considered criminal and punished as such. Such an interpretation is therefore inapplicable, It must be placed on record that the coca leaf is transformed into a drug when it is subjected to chemical processes which involve the use of equipment and materials which do not originate in Bolivia, At the same time, the Republic of Bolivia will take all necessary legal measures to control the licit cultivation, use, consumption and purchase of the coca leaf in order to prevent its diversion to the production of narcotic drugs. 8 | Bekrachtiging door de Europese Economische Gemeenschap onder de volgende verklaring: Competence of the European Economic Community as regards the matters covered by the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances (Declaration pursuant to Article 27(2) of the Convention) Article 27(2) of the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances stipulates that, in their instruments of formal confirmation, regional economic integration organizations shall declare the extent of their competence with respect to the matters covered by this Convention. The European Economic Community was established by the Treaty of Rome which was signed on 25 March 1957 and entered into force on 1 January 1958. This Treaty was amended and supplemented by the Single European Act, which entered into force on July 1987. In accordance with the provisions referred to above, the European Economic Community is at present competent for questions of commercial policy relating to the substances frequently used in the illicit manufacture of narcotic drugs and psychotropic substances, questions which are dealt with in Article 12 of the Convention. The exercise of the powers which the Member States have transferred to the Communities under the Treaties is, by its nature, subject to continuous development. 9 | Bekrachtiging door Frankrijk onder de volgende voorbehouden: The Government of the French Republic does not consider itself bound by the provisions of article 32, paragraph 2, and declares that any dispute relating to the interpretation or application of the Convention which cannot be settled in the manner prescribed in paragraph 1 of the said article may not be referred to the International Court of Justice unless all the parties to the dispute agree thereto. The Government of the Italian Republic considers this reservation to be problematic in the light of the object and purpose of the Convention. The reservation made in respect of article 6 is contrary to the principle ‘aut dedere aut iudicare’ which provides that offences are brought before the court or that extradition is granted to the requesting States. The Government of the Italian Republic is therefore of the opinion that the reservation jeopardizes the intention of the Convention, as stated in article 2 paragraph 1, to promote cooperation among the Parties so that they may address more effectively the international dimension of illicit drug trafficking. The reservation may also raise doubts as to the commitment of the Government of Viet Nam to comply with fundamental provisions of the Convention. It is in the common interest of States that international treaties which they have concluded are respected, as to their object and purpose, and that all Parties are prepared to undertake any legislative and administrative changes necessary to comply with their obligations. The Government of the Italian Republic therefore objects to the reservation. This objection does not preclude the entry into force of the Convention between the Italian Republic and Viet Nam. In consideration of this position, the Holy See has decided to sign the Convention against illicit trafficking in narcotics as a gesture of encouragement vis-à-vis the commitment of the countries that intend to fight against such criminal activity. 77 | Luxemburg heeft op 16-10-2019 de volgende verklaring afgelegd: Pursuant to article 7 (8), and as a replacement of the initial designation made at the time of the deposit of the instrument of ratification, the Government of the Grand Duchy of Luxembourg has designated the State Attorney General as the authority with the responsibility and power to execute requests for mutual legal assistance or to transmit them to the competent authorities for execution.
