The payment of insurance money to the policyholder or insured, as the case may be, will only discharge the insurer from its obligation towards the victim if the victim

(a)

has waived his direct claim or

(b)

has not notified the insurer about his intention to make a direct claim within four weeks of receiving the insurer's request in writing.
