behorende bij artikel 21 van de Regeling genetisch gemodificeerde organismen milieubeheer 2013
Op grond van artikel 2.10, eerst[lees: eerste] lid, van het Besluit kan de Minister combinaties van lijsten vaststellen voor de vervaardiging van genetisch gemodificeerde organismen van inperkingsniveau I in een of meer daarbij aangegeven categorieën van fysische inperking. De vaststelling van de combinatie van lijsten is geschied in artikel 21 van deze regeling. In dat artikel wordt voor de vastgestelde combinaties van lijsten verwezen naar de combinaties van lijsten opgenomen in deze bijlage.
De vaststelling van een combinatie van lijsten omvat daarbij op grond van artikel 2.10 van het Besluit:
- –
een lijst met gastheerorganismen;
- –
een lijst met vectoren;
- –
een lijst met inserties die een sequentie bevat die het in te brengen genetisch materiaal niet mag bevatten;
- –
een daarbij aangegeven categorie van fysische inperking.
De risicobeoordeling van daarbij aangegeven samenstellingen van onderdelen uit de lijsten leidt tot inschaling op inperkingsniveau I. Deze inschaling is alleen van toepassing op ingeperkt gebruik onder laboratoriumcondities.
De gebruiker behoeft geen risicobeoordeling uit te voeren, indien hij voornemens is onder laboratoriumcondities een genetisch gemodificeerd organisme te vervaardigen dat is samengesteld uit gastheerorganismen en een of meer vectoren die zijn opgenomen in een combinatie van lijsten en waarvan de insertie of inserties niet is of zijn vermeld op de lijst die behoort tot dezelfde combinatie van lijsten.
Combinatie A:
Activiteiten met een genetisch gemodificeerd organisme:
- a.
dat is samengesteld uit een gastheerorganisme en een of meer vectoren, die zijn opgenomen op respectievelijk lijst A1 en lijst A2, en
- b.
waarvan de insertie of inserties, voor zover deze niet behoort of behoren tot een vector, niet is of zijn vermeld op lijst A3,
worden uitgevoerd op: ML-I.
Lijst A1. Gastheerorganismen behorende bij combinatie A
Op deze lijst A1 zijn gastheersoorten opgenomen die zijn gesorteerd op hun bijbehorende geslachtsnaam. Voor de werking van deze lijst betekent dit, dat alleen de soorten die zijn opgenomen op deze lijst, als apathogene gastheer in de context van bijlage 5 van deze regeling mogen worden gehanteerd.
Een soort die behoort tot een geslacht dat op deze lijst staat vermeld, maar waarbij deze soort zelf niet op de lijst is opgenomen, mag niet onder het regime van deze lijst worden gehanteerd.

Inserties die één of meer van de onderstaande sequenties bevatten:
- 1.
Ongekarakteriseerde sequenties:
Een sequentie wordt in ieder geval beschouwd als ongekarakteriseerd indien een of meerdere van de hierna genoemde gegevens ontbreken:
- a.
de herkomst en de aard van de sequenties;
- b.
de wijze waarop de insertie is geconstrueerd;
- c.
een onderbouwing van welke functie of functies de sequentie kan hebben.
Aandachtspunten bij de onderbouwing bedoeld onder c, zijn de functie en de relatieve posities van structurele genen, regulerende sequenties, synthetische sequenties, van transposons en provirussen afgeleide sequenties en sequenties die van belang zijn voor de replicatie in het genetisch gemodificeerde organisme.
- 2.
Sequenties coderend voor:
- a.
toxines en cytolysines met een LD50 voor vertebraten van 100 microgram of minder per kilogram lichaamsgewicht;
- b.
overige virulentie- en pathogeniteitsfactoren;
- c.
virale en cellulaire oncogenen in combinatie met een virale vector die virale sequenties bevat die betrokken zijn bij integratie of replicatie;
- d.
enzymatische functies die betrokken zijn bij transpositie of integratie van transposons of provirussequenties;
- e.
functies die leiden tot zelfstandige overdracht van genetisch materiaal;
- f.
functies waardoor de insertie als virale vector kan functioneren;
- g.
een antibioticumresistentie die van nature niet voorkomt in de soort waartoe de gastheer behoort, of in aanverwante soorten, indien daardoor de toepassing van medicijnen ter bestrijding van ziekteverwekkers in gevaar wordt gebracht.
