28.1.
In applying the rules of lis pendens, the scope of the proceeding is determined by the claims in the parties' pleadings, including amendments.
28.2.
In applying the rules of claim preclusion, the scope of the claim or claims decided is determined by reference to the claims and defenses in the parties' pleadings, including amendments, and the court's decision and reasoned explanation.
28.3.
The concept of issue preclusion, as to an issue of fact or application of law to facts, should be applied only to prevent substantial injustice.
