Artikel 4:103 Termination in the case of partial delivery and partial conformity

If the seller delivers only a part of the goods, or if only a part of the goods delivered is in conformity with the contract, the right to termination under Article 9:301 of the Principles of European Contract Law applies in respect of the part which is missing or which does not conform.

However, where the failure to supply the missing part or the supply of the non-conforming part amounts to a fundamental non-performance on the part of the seller, the buyer may terminate the entire contract.
