Article 8:103 (a) of the Principles of European Contract Law (which provides that a non-performance of an obligation is fundamental if strict compliance with the obligation is of the essence of the contract) applies only if the parties have expressly agreed, or if it is obvious from the circumstances, that compliance with the obligation is of the essence of the contract.
(2)
In a consumer sale, the buyer may terminate the contract for fundamental non-performance in the case of any lack of conformity unless the lack of conformity is minor.
