The insurer shall not be entitled to refuse payment by a third party if

(a)

the third party acts with the assent of the policyholder; or

(b)

the third party has a legitimate interest in maintaining the cover and the policyholder has failed to pay or it is clear that he will not pay at the time payment is due.
