(1)
When the goods do not conform to the contract the buyer is entitled, subject to the provisions of this Chapter:
- (a)
to have the lack of conformity remedied by repair, replacement or other means in accordance with Articles 4:202 to 4:204 (which apply in place of Article 8:104 and Chapter 9, Section 1 of the Principles of European Contract Law);
- (b)
to withhold performance under Chapter 9, Section 2 of the Principles of European Contract Law;
- (c)
to termination of the contract for fundamental non-performance under Chapter 9, Section 3 of the Principles of European Contract Law;
- (d)
to price reduction under Chapter 9, Section 4 of the Principles of European Contract Law; or
- (e)
to damages under Chapter 9, Section 5 of the Principles of European Contract Law.
