The following restrictions do not prevent an agreement from benefitting from the safe harbour of the De Minimis Notice:

In the context of R&D agreements covered by Commission Regulation (EU) 1217/2010, where the parties agree to restrict their freedom, during the period of the agreement, to carry out, independently or in cooperation with third parties, research and development in the field covered by the R&D cooperation.1.

In the context of technology transfer agreements covered by Commission Regulation (EU) No 316/2014, where the parties agree to restrict the licensee's ability to exploit its own technology or the ability of any of the parties to carry out research and development when this is indispensable to prevent disclosure of know-how to third parties.2.
