The discharge of a trust debtor by a trustee is of no effect if:
- (a)
the discharge is not in performance of the trustee's obligations under the trust; and
- (b)
- (i)
the discharge is gratuitous; or
- (ii)
the debtor knows or has reason to know that the discharge is not in performance of the trustee's obligations under the trust.
