Where a trustee has a right to performance and that right is a trust asset, the right to enforce performance of the obligation of the debtor (the trust debtor) accrues to the trustee.
(2)
Paragraph (1) does not affect:
- (a)
a beneficiary's right to performance by the trustee of obligations under the trust in respect of the right against the trust debtor; or
- (b)
procedural rules which allow a beneficiary to be a party to legal proceedings against the trust debtor to which the trustee is also a party.
