The contract may derogate from all other provisions as long as such derogation is not to the detriment of the policyholder, the insured or beneficiary.

Derogation in the sense of para. 2 shall be allowed to the benefit of any party in contracts covering large risks within the meaning of Article 13 para. 27 Directive 2009/138/EC. In group insurance a derogation shall only be held against an individual insured who fulfills the personal characteristics mentioned in Article 13 para. 27(b) or (c) Directive 2009/138/EC, where applicable.
