The Host State shall allow the detention of persons, whose arrest and detention as suspects or accused is ordered by the Kosovo Relocated Specialist Judicial Institution in accordance with Law No. 05/L-053. The detention of other persons is not permitted in the Host State, except in so far as the Kosovo Relocated Specialist Judicial Institution orders:
- a)
the temporary detention of witnesses transferred in custody to the premises of the Kosovo Relocated Specialist Judicial Institution;
- b)
the temporary detention of witnesses in the course of their evidence, including for contempt of court;
- c)
the continued detention of persons pending transfer on the basis of Articles 43 or 44 of this Agreement.

The Host State shall facilitate detention within the premises of the Kosovo Relocated Specialist Judicial Institution. The detention within the premises of the Kosovo Relocated Specialist Judicial Institution shall end upon the termination of this Agreement.
3.
The Host State shall, in accordance with the procedures under its national law and at the request of the Kosovo Relocated Specialist Judicial Institution, arrest on its territory and surrender to the Kosovo Relocated Specialist Judicial Institution any person who has escaped detention from the premises of the Kosovo Relocated Specialist Judicial Institution or has evaded such detention during transport in the territory of the Host State.
