An employed person, being employed in the territory of one Contracting Party, shall be subject to the legislation of that Contracting Party even if he resides in the territory of the other Contracting Party or if the registered office or place of business of the undertaking or individual employing him is situated in the territory of the other Contracting Party.
2.
An employed person, being employed in the territory of both Contracting Parties shall be subject to the legislation of the Contracting Party in the territory of which he is resident. If he is not resident in the territory of either Contracting Party he shall be subject to the legislation of the Contracting Party in the territory of which the employer has his principal place of business.
3.
Travelling personnel employed by an undertaking which for hire or reward or on its own account operates international transport services for passengers or goods shall be subject to the legislation of the Contracting Party in whose territory the undertaking has its head office, even if the employed person concerned resides in the territory of the other Contracting Party. If however an employed person is employed by a branch or permanent agency which the said undertaking has in the territory of the other Contracting Party or if that person is employed and resident in the territory of this Contracting Party, the legislation of this Contracting Party shall apply.
