Contract terms are not subjected to an unfairness test under this Section if they are based on:

(a)

provisions of the applicable law;

(b)

international conventions to which the Member States are parties, or to which the European Union is a party; or

(c)

these rules.

(2)

For contract terms which are drafted in plain and intelligible language, the unfairness test extends neither to the definition of the main subject matter of the contract, nor to the adequacy of the price to be paid.
