(1)

A business which offers the facility to conclude a contract by electronic means and without individual communication has a duty to acknowledge by electronic means the receipt of an offer or an acceptance by the other party.

(2)

If the other party does not receive the acknowledgement without undue delay, that other party may revoke the offer or withdraw from the contract.

(3)

The business is liable for any loss caused to the other party by a breach of the duty under paragraph (1).

(4)

In relations between a business and a consumer the parties may not, to the detriment of the consumer, exclude the application of this Article or derogate from or vary its effects.
