If the social security system of the Tribunal offers coverage comparable to the coverage under the legislation of the host State, the Tribunal and the judges, the Prosecutor, the Deputy Prosecutor, the Registrar, the Head of the Defence Office and staff to whom the aforementioned scheme applies shall be exempt from social security provisions of the host State. Consequently, they shall not be covered against the risks described in the social security provisions of the host State. This exemption applies to them, unless they take up gainful activity in the host State.

Paragraph 1 of this article shall apply, mutatis mutandis, to members of the family forming part of the household of the persons referred to in paragraph 1, unless they are engaged in gainful employment in the host State, or are self-employed, or receive social security benefits from the host State.
