The provisions of this Chapter shall not apply where:

a)

the export of a cultural object is no longer illegal at the time at which the return is requested; or

b)

the object was exported during the lifetime of the person who created it or within a period of fifty years following the death of that person.

2.

Notwithstanding the provisions of sub-paragraph b of the preceding paragraph, the provisions of this Chapter shall apply where a cultural object was made by a member or members of a tribal or indigenous community for traditional or ritual use by that community and the object will be returned to that community.
