When the agent is entitled to a price, the price is presumed to include the reimbursement of the expenses the agent has incurred in the performance of the obligations under the mandate contract.
(2)
When the agent is not entitled to a price or when the parties have agreed that the expenses will be paid separately, the principal must reimburse the agent for the expenses the agent has incurred in the performance of the obligations under the mandate contract, when and in so far as the agent acted reasonably when incurring the expenses.
(3)
The agent is entitled to reimbursement of expenses under paragraph (2) as from the time when the expenses are incurred and the agent has given account of the expenses.
(4)
If the mandate relationship has terminated and the result on which the agent's remuneration is dependent is not achieved, the agent is entitled to reimbursement of reasonable expenses the agent has incurred in the performance of the obligations under the mandate contract. Paragraph (3) applies accordingly.
