(1)
The treatment provider may not carry out treatment unless the treatment provider has obtained prior informed consent from the patient.
(2)
The patient may withdraw consent at any time.
(3)
In so far as the patient is incapable of giving consent, the treatment provider must:
- (a)
obtain informed consent from a person or institution legally entitled to take decisions regarding the treatment on behalf of the patient; or
- (b)
comply with any rules or procedures enabling treatment to be lawfully given without such consent.
(4)
In the situation described in paragraph (3), the treatment provider must, in so far as possible, consider the opinion of the incapable patient, and the opinion of the patient expressed before the patient became incapable.
(5)
In the situation described in paragraph (3), the treatment provider may only carry out treatment that is intended to improve the health condition of the patient.
(6)
In the situation described in Article 7:106(2), consent must be given in an express and specific way.
(7)
This Article does not apply if the treatment must be provided in an emergency.
