In a consumer contract for sale, the risk does not pass until the buyer takes over the goods.
(2)
Paragraph (1) does not apply if the buyer has failed to perform the obligation to take over the goods and the non-performance is not excused under III. — 3:104 (Excuse due to an impediment) in which case IV. A. — 5:201 (Goods placed at buyer's disposal) applies.

Except in so far as provided in the preceding paragraph, Section 2 of this Chapter does not apply to a consumer contract for sale.

The parties may not, to the detriment of the consumer, exclude the application of this Article or derogate from or vary its effects.
