A decision by the Pre-Trial Chamber to confirm or not to confirm a decision taken by the Prosecutor solely under article 53, paragraph 1(c) or 2(c), must be concurred in by a majority of its judges and shall contain reasons. It shall be communicated to all those who participated in the review.

2.

When the Pre-Trial Chamber does not confirm the decision by the Prosecutor referred to in sub-rule 1, he or she shall proceed with the investigation or prosecution.
