The creditor is entitled to damages for loss caused by the debtor's non-performance of an obligation, unless the non-performance is excused.

The loss for which damages are recoverable includes future loss which is reasonably likely to occur.

‘Loss’ includes economic and non-economic loss. ‘Economic loss’ includes loss of income or profit, burdens incurred and a reduction in the value of property. ‘Non-economic loss’ includes pain and suffering and impairment of the quality of life.
