Where a person surrendered to the Tribunal is released from the custody of the Tribunal because the Tribunal does not have jurisdiction, the case is inadmissible, the charges have not been confirmed, the person has been acquitted at trial or on appeal, or for any other reason, the Tribunal shall, as soon as possible, make such arrangements as it considers appropriate for the transfer of the person, taking into account the views of the person, to a State which is obliged to receive him or her, to another State which agrees to receive him or her, or to a State which has requested his or her extradition with the consent of the original surrendering State.
2.
The provisions of article 39 of this Agreement shall apply, mutatis mutandis, to the transport of persons referred to in this article within the host State.
3.
The Tribunal shall not release a person referred to in this article on the territory of the host State except with the latter's consent.
