Any dispute between two or more Contracting Parties concerning the interpretation or application of this Convention which cannot be settled through negotiation shall, at the request of one of them, be submitted to arbitration.

The request for arbitration shall include a description of the claim to be submitted and a summary statement of the grounds on which the claim is based.

Unless the parties agree otherwise, the arbitration commission shall be composed of one member appointed by each party to the dispute and an additional member, who shall be the chairman, chosen in common agreement between the parties. The arbitration commission shall decide on the matters placed before it by simple majority and its decisions shall be binding on the parties. Other details of procedure shall be determined by special agreement between the parties.

Notwithstanding the provisions of paragraph 3, the parties may agree to submit the dispute to arbitration in accordance with another arrangement operating between the parties.

If within six months from the date of the request for arbitration the parties are unable to agree on the organisation of the arbitration, any one of those parties may refer the dispute (as referred to in paragraph 1) to the International Court of Justice by request in conformity with the Statute of the Court.
6.
Notwithstanding the provision of paragraph 1, the parties may agree to submit the dispute to the International Court of Justice.
