An assignment of an existing claim takes effect at the time of the agreement to assign or such later time as the assignor and assignee agree.
(2)
An assignment of a future claim is dependent upon the assigned claim coming into existence but thereupon takes effect from the time of the agreement to assign or such later time as the assignor and assignee agree.
