A right to benefit or eligibility for benefit is valid only in so far as the benefit is sufficiently defined in the trust terms or is otherwise ascertainable at the time the benefit is due or to be conferred.

(2)

If the benefit to be conferred is not ascertainable only because a third party cannot or does not make a choice, the trustees may make that choice unless the trust terms provide otherwise.
