The goods do not conform with the contract if they do not possess the qualities which the donee could reasonably expect unless the donee knew of the lack of quality or could reasonably be expected to have known of it when the contract was concluded.

In determining what qualities the donee could reasonably expect, regard is to be had, among other things, to:

(a): the gratuitous nature of the contract;
(b): the purpose of the contract of donation known by, or obvious to, the donee;
(c): whether the transfer or delivery of the goods was immediate;
(d): the value of the goods; and
(e): whether the donor was a business.

The goods do not conform to the contract if they are not of a quantity, quality or description provided for by the terms of the contract.
