(1)
A trustee has a right to such remuneration out of the trust fund as is provided for by the trust terms.
(2)
Unless this is inconsistent with the trust terms, a trustee who acts as a trustee in the course of a profession has a right to reasonable remuneration out of the trust fund for work done in performance of the obligations under the trust.
(3)
Paragraph (2) does not apply if:
- (a)
the trustee, in the capacity of beneficiary, is entitled to significant benefit from the trust fund; or
- (b)
the trust was created as a result of a contract between the trustee and the truster; or
- (c)
the trust is for the advancement of public benefit purposes.
