(1)
If a contract is to be concluded by electronic means and without individual communication, a business has a duty to provide information about the following matters before the other party makes or accepts an offer:
- (a)
the technical steps to be taken in order to conclude the contract;
- (b)
whether or not a contract document will be filed by the business and whether it will be accessible;
- (c)
the technical means for identifying and correcting input errors before the other party makes or accepts an offer;
- (d)
the languages offered for the conclusion of the contract;
- (e)
any contract terms used.

The business has a duty to ensure that the contract terms referred to in paragraph (1)(e) are available in textual form.
(3)
If a business has failed to comply with the duty under paragraph (1) and a contract has been concluded in the circumstances there stated, the other party has a right to withdraw from the contract by giving notice to the business within the period specified in II. — 5:103 (Withdrawal period).

A business is liable to the consumer for any loss caused by a breach of the duty under paragraph (1).
