This Part does not apply where:

(a): performance of the obligation to transfer is due only on the donor's death;
(b): the transfer or obligation to transfer is subject to the suspensive condition of the donor's death; or
(c): the transfer or obligation to transfer is made subject to the resolu-tive condition of the donee predeceasing the donor.

Paragraph (1) does not apply if the donor renders performance or waives the condition before the donor's death.
