(1)

A trustee is obliged to administer the trust fund and exercise any power to dispose of the fund as a prudent manager of another's affairs for the benefit of the beneficiaries or the advancement of the public benefit purposes, in accordance with the law and the trust terms.

(2)

In particular, a trustee is obliged to act with the required care and skill, fairly and in good faith.

(3)

Except in so far as the trust terms provide otherwise:

(a)

these obligations include the particular obligations set out in X. — 6:102 (Required care and skill) and the following sub-section; and

(b)

an administration or disposal of the trust fund is of benefit to a beneficiary only if it is for that person's economic benefit.
