A trustee is required to act with the care and skill which can be expected of a reasonably competent and careful person managing another's affairs, having regard to whether the trustee has a right to remuneration.
(2)
If the trustee is acting in the course of a profession, the trustee must act with the care and skill that is expected of a member of that profession.
