On the application of any party to the trust or any person entitled to enforce performance of obligations under the trust, a court may vary a trust term which provides for the advancement of a public benefit purpose if, as a result of a change of circumstances, the advancement of the particular purpose provided for by the trust term cannot be regarded as a suitable and effective use of resources.
(2)
A variation under paragraph (2) must be in favour of such general or particular public benefit purposes as the truster would probably have chosen if the truster had constituted the trust after the change in circumstances.
