The preceding Article does not apply:

(a)

in the case of an immediate delivery of the goods to the donee or an equivalent to such delivery, regardless of whether ownership is transferred;

(b)

if the donation is made by a business;

(c)

if the undertaking of the donor is declared in a public statement broadcast in the radio or television or published in print and is not excessive in the circumstances.
