(1)
The secured creditor is not entitled to take possession of an encumbered corporeal asset, unless:
- (a)
the security provider consents at the time when the secured creditor exercises this right; or
- (b)
the security provider had agreed to the secured creditor's right to take possession and neither the security provider nor the actual holder objects at the time when the secured creditor exercises this right.
(2)
In enforcements against a consumer, the right to take possession according to paragraph (1) does not arise until ten days have elapsed since an enforcement notice has been served.
(3)
Unless it indicates otherwise, a consent or agreement to the taking of possession according to paragraph (1) covers the right to enter the security provider's or other holder's premises for the purpose of exercising the right to take possession.
