A person has a defence if the person suffering the damage validly con-sents to the legally relevant damage and is aware or could reasonably be expected to be aware of the consequences of that consent.

The same applies if the person suffering the damage, knowing the risk of damage of the type caused, voluntarily takes that risk and is to be regarded as accepting it.
