(1)

The consequences of production, combination or commingling can be regulated by party agreement. The provisions of Section 2 apply where production, combination or commingling takes place:

(a)

without the consent of the owner of the material; or

(b)

with the consent of the owner of the material, but without a party agreement as to the proprietary consequences.

(2)

An agreement in the sense of paragraph (1) may provide for:

(a)

proprietary rights as recognised by this Book; and

(b)

a right to payment or other performance.

(3)

The effects of production, combination and commingling as to goods subject to a retention of ownership device are regulated by Book IX.

(4)

Proprietary security rights created under Section 2 of this Chapter are subject to the provisions on proprietary security rights in Book IX, unless provided otherwise in Section 2. Proprietary security rights created by a party agreement under paragraph (1) are subject to the provisions on proprietary security rights in Book IX except as provided otherwise by VIII. — 5:204 (Additional provisions as to proprietary security rights) paragraph (3).

This Chapter does not affect the applicability of the rules on non-contractual liability for damage (Book VI). The rules on benevolent intervention in another's affairs (Book V) have priority over the provisions of this Chapter.
