(1)

The recipient is obliged to:

(a)

pay the value (at the time of performance) of a benefit which ceases to be transferable after the time when its return was due; and

(b)

pay recompense for any reduction in the value of a returnable benefit as a result of a change in the condition of the benefit after the time when its return was due.

(2)

If the benefit is disposed of after the time when return was due, the value to be paid is the value of any proceeds, if this is greater.

(3)

Other liabilities arising from non-performance of an obligation to return a benefit are unaffected.
