Banks and equivalent financial institutions holding financial assets as secured creditors are entitled to use, appropriate and dispose of the encumbered assets, provided this is expressly agreed.

(2)

Upon satisfaction of the secured right, the secured creditor is only obliged to transfer financial assets of the same kind, quality and value to the security provider.
