The requirements referred to in Section 1 (Basic rules on constitution by juridical act) for a declaration of an intention to constitute a trust are that:
- (a)
the declaration is made by the truster or a person who has authority to make it on the truster's behalf; and
- (b)
the declaration complies with any requirement as to form set out in X. — 2:203 (Formal requirements for declaration).

No notice or publication of the declaration to any party is required.
